Agrilin (Platform), is a website owned and operated by GROWCOMS PRIVATE LIMITED (Company). Agrilin provides a platform that enables users to trade in agricultural products domestically and internationally (Services). Agrilin is a Business to Business (B2B) platform, and during the course of operating the Platform and providing the Services, we collect and process user data. 'We/we' or 'Us/us/Our/our' refers to the Company, and ‘You/Your/Users/you/your/users’ refers to the users of our Platform and/or Services.

This privacy policy (Privacy Policy) applies to and governs the use of the Platform and any services which may be provided to you through the Platform while you use the Platform and/or while dealings with any products available on the Platform (Products).

This Privacy Policy shall apply to you regardless of how you access or use the Services. 1. Personal Information

While accessing and/or using the Platform, we may ask you to provide us with certain information which may be personally identifiable information that can be used to contact or identify you (Personal Information). We use your Personal Information to provide and perform the Services, process payments, communicate with you, update our records, maintain your transaction history with us and other activities ancillary to the operation of the Platform. We also use this information to improve the Platform and enable third parties to carry out certain functions on our behalf. Wherever possible, we may indicate the kind of information that may be mandatorily required and the information which are optional. The information in our database may be supplemented by any voluntary information you provide through either online or offline means including the provision of sensitive personal data or information including financial information such as bank account or other payment instrument details.

We use your information to provide our Services, process payments, communicate with you, maintain records and generally maintain your transaction history with us. We shall also use this information to improve the Platform, protect and secure the Platform, prevent or detect fraud or abuses and enable third parties to carry out certain activities on our behalf which are crucial to the Platform.

We broadly classify the information you provide into information You affirmatively and voluntarily give to us and information automatically collected when you visit our Platform and/or avail any Services. We have attempted to classify the information we collect as under:

Contact Information: We shall collect and store any information you voluntarily enter on the Platform or give us in any other manner. By using or continuing to use the Platform, you provide us your consent to use your information (including sensitive personal information) in accordance with this Privacy Policy, as may be amended from time to time by us at our sole discretion. You also agree and consent to us collecting, storing, processing, transferring and sharing information (including sensitive Personal Information) related to You with third parties or service providers for the purposes as set forth in this Privacy Policy.

Other Data: While using the Platform and/or availing the Services, we may request you to provide us with applicable information that we may require in order to make the Platform accessible to you and render the Services to you from time to time. In order to provide the full range of Services, we may also collect certain Information, including but not limited to contact details of people you refer to us, information provided by you while initiating and running a task, including, without limitation: search words, keywords, location, products or services being sought, reviews, rating, order details and history, pictures of items ordered or uploaded, for which a task is run and all chat history, etc. We may further collect documents from you (where required) including to meet know-your-customer (KYC) requirements, and other legal requirements (such as those under the Prevention of Money Laundering Act, 2002, Financial Action Taskforce recommendations, Customs Act, 1962, Customs Tariff Act, 1975, Reserve Bank of India Act, 1994, Foreign Exchange Management Act, 1999, etc.). Further, we may ask you to provide additional information about Yourself on an optional basis. We may also ask you for certain financial information, including bank account or other payment instrument details to process payments on the Platform (online or offline). We may store such information provided to us. We use such information as provided by you to authenticate and authorize access to the Platform and to provide the Services to you through the Platform. We may also process and analyze and process such information to improve the Platform and our Services. We also collect and prepare aggregated data such as statistical and/or demographic data including that derived from Personal Information for internal purposes. We may use or share this for internal purposes.

2. Governmental Investigations, Public Display and Authorized Third Party Activities

We may be required to share all information collected with governmental authorities and agencies for the purposes of verification of identity or for prevention, detection or investigation, including of cyber incidents, prosecution and punishment of offences. You agree and consent for the Company to disclose your information, if so required, under applicable law. You shall fully indemnify us in a manner provided for under the Terms of Use for any losses that may arise due to or out of inaccurate information provided by you.

Legitimate interests include establishing and maintaining relationships, servicing their anticipated and actual needs, and for administrative purposes. The Company at no occasion is responsible for any form of transmission, whatsoever, received by you from any third-party websites. Accordingly, the Company does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such third-party websites, nor does the Company control or guarantee the accuracy, integrity, or quality of the information, data, text, software, music, sound, photographs, graphics, videos, messages or other materials available on such third-party websites.

When You use the Platform, we try to make that experience simple and meaningful. 7. Persons allowed to Use the Platform

The Platform is only available to those who can form a legally binding contract under the Indian Contract Act, 1872. Minors and other legally incapacitated persons under Indian law may not use the Platform or avail of any of the Services.

Please note that in the event such persons utilizing the Platform and/or the Services, it is assumed that he/she/the legal guardian/entity who has given access to the Platform/ Services or has responsibility over the unauthorised user has authorized the person for such use and thereby accorded their consent for the terms of the Privacy Policy.

8. Grievances and Policy Related Communication

You may report your concern(s) and request(s) to the grievance officer immediately upon occurrence of the first instance of occurrence of the event. The grievance officer shall redress the grievances within such time as commercially practicable from date of receipt of such grievance.

10. Applicable Law and Jurisdiction

While you may use this website from any jurisdiction wherefrom access to the same is possible either directly or through virtual private networks; the Company, the Platform and the Services are provided in compliance with Indian law, and this Privacy Policy shall be governed and construed exclusively in accordance with the laws of India and the courts at Ernakulam, Kerala, India shall have exclusive jurisdiction in respect of all matters pertaining to this Privacy Policy.

Notwithstanding the foregoing, Paragraph 15 of the Terms of Use on ‘Governing Law and Dispute Resolution’ is incorporated, mutatis mutandis, to this Privacy Policy.
